Please read these terms carefully before using TechBids.

1. Acceptance of Terms

By accessing or using TechBids.ca (the "Site") and its services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Site or Services. These Terms constitute a legally binding agreement between you and TechBids.ca ("TechBids", "we", "us", or "our"), operated from Ottawa, Ontario, Canada.

2. Description of Services

TechBids provides a subscription-based platform that aggregates and displays Canadian government technology procurement opportunities. Our Services include:

  • Access to a searchable database of technology-related government bids from across Canada
  • AI-powered classification and summarization of procurement opportunities
  • Daily email notifications of new relevant opportunities
  • Bid tracking and pipeline management tools

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

3. Account Registration

To access the Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age or the age of majority in your province or territory to create an account. Each subscription is for a single user; sharing login credentials with others is not permitted.

4. Subscription and Payment

4.1 Billing. TechBids offers monthly, quarterly, and yearly subscription plans. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable rate. All prices are in Canadian Dollars (CAD) and are exclusive of applicable taxes (GST/HST/QST).

4.2 Payment Processing. Payments are processed securely through Stripe. We do not store your full credit card information. By providing payment information, you represent that you are authorized to use the payment method.

4.3 Price Changes. We reserve the right to change our subscription prices. If we do, we will provide you with at least 30 days' notice before the new price takes effect. Continued use of the Services after the price change constitutes acceptance of the new price.

4.4 Failed Payments. If a payment fails, we may retry the charge or suspend your access until the payment issue is resolved.

5. Cancellation

You may cancel your subscription at any time through your account billing settings. Upon cancellation:

  • Your access to the Services will continue until the end of your current billing period
  • No further charges will be made after the current billing period ends
  • No partial refunds are issued for unused time within a billing period (except as outlined in our Refund Policy)

We may also terminate or suspend your account if you violate these Terms or engage in fraudulent or abusive behavior.

6. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
  • Reproduce, redistribute, sell, or commercially exploit the data or content on the Site without our written permission
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems
  • Use automated tools, bots, or scripts to access or scrape the Site (except as expressly authorized)
  • Interfere with or disrupt the integrity or performance of the Services
  • Share your account credentials with any third party
  • Circumvent any security or access controls

We reserve the right to suspend or terminate your account if we reasonably believe you are violating these terms.

7. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, icons, software, and the overall design and arrangement of the Site, is the property of TechBids or its licensors and is protected by Canadian and international intellectual property laws.

The procurement bid data displayed on TechBids is sourced from publicly available government procurement portals. While we aggregate and organize this data, the underlying bid content remains the property of the respective government agencies. We do not claim ownership of the original bid content.

Our AI-generated summaries, classifications, and analysis are proprietary content owned by TechBids.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

While we strive to provide accurate and up-to-date information, we do not warrant that:

  • The bid information displayed on the Site is complete, accurate, or current at all times
  • The Services will be uninterrupted, error-free, or free of viruses or other harmful components
  • The AI-generated summaries or classifications are error-free

You should always verify bid details directly with the issuing government agency before submitting a response. TechBids is a discovery and notification tool, not a substitute for due diligence.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHBIDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or business interruption
  • Damages arising from missed bids, deadlines, or procurement opportunities
  • Damages resulting from inaccurate bid information or AI classifications

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO TECHBIDS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless TechBids and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts of the Province of Ontario, and you consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date. We may also notify you by email for significant changes. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
